According to Mr. Michael Aondoakaa, SAN, a former attorney general of the federation and minister of justice, President Tinubu lacks the authority to terminate CBN Governor Godwin Emefiele. According to Aondoakaa, Emefiele can only be removed from office if two-thirds of the Senate votes against him.

Mr. Aondoakaa made this revelation during a Friday afternoon interview on Arise Television, emphasizing the distinction between suspension and dismissal.

He said that suspension is not the same as removal because the president (Tinubu) can only remove him (Emefiele) with two-thirds of the Senate’s approval.

Additionally, he claimed that it is obvious from the Supreme Court’s recent ruling on the redesign of the Naira that the Central Bank of Nigeria is thought to be an agent of either the federal government or the president, depending on the circumstance.

Mr. According to Aondoakaa, there are set time limits for when someone can be detained, arrested, and then charged in court. In addition, he said that when discussing Godwin Emefiele’s ongoing detention by DSS agents, we must be able to distinguish between arrest, detention, and investigation.

Additionally, he stated that an arrest is only possible if the suspect can obstruct the ongoing investigation or is likely to flee, stressing that an investigation does not always end with an arrest. He continued by stating that when a person is detained for a period of time that exceeds the constitutional limit, a problem occurs.

Keep in mind that the administration of Bola Ahmed Tinubu recently demoted Godwin Emefiele, the Governor of the Central Bank of Nigeria. Since his suspension, the DSS has kept him in custody.
