Justice Rahman Oshodi of the Lagos State Special Offences Court in Ikeja has dismissed an application for his recusal from the ongoing trial of former Central Bank of Nigeria (CBN) Governor Godwin Emefiele.
Delivering his ruling on Wednesday, Justice Oshodi stated that the defence team’s allegations of bias were unsubstantiated and lacked evidence to justify his withdrawal from the case.
On Monday, the defense, led by Olalekan Ojo (SAN), had requested the judge to step down, arguing that his previous rulings suggested a likelihood of bias. However, Rotimi Oyedepo (SAN), counsel for the Economic and Financial Crimes Commission (EFCC), opposed the application, maintaining that the trial had been conducted fairly.
After reviewing the arguments, Justice Oshodi ruled:
“The claims of bias have not been substantiated by either of the defendants. Accordingly, the first and second defendants’ recusal application is refused.”
With this ruling, the trial of Emefiele will proceed as scheduled, as he continues to face charges of financial misconduct and abuse of office.
