A Federal High Court in Abuja has refused an application seeking to stop Senator Ireti Kingibe from participating in activities of the African Democratic Congress over her alleged suspension.
Justice Peter Lifu ruled that the request could not be granted without first hearing from the senator, emphasizing the need for fairness in handling political disputes.
The court directed the plaintiffs to serve Kingibe with all relevant documents so she can respond to the allegations before any decision is taken.
According to the judge, applications of this nature require careful consideration, noting that both parties must be given the opportunity to present their case.
The suit was filed by Okezuo Anayo and Isaiah Samuel on behalf of ward members in Wuse, Abuja.
They claimed that the senator was suspended on March 10 over alleged anti party activities, misconduct and disregard for the party’s constitution. The plaintiffs asked the court to restrain her from presenting herself as a party member, attending meetings or engaging in party affairs.
They also accused her of continuing to hold meetings, issue statements and interfere in ward activities despite the suspension, describing her actions as a violation of party processes.
Counsel to the senator, Abubakar Marshall, informed the court that a preliminary objection has already been filed challenging the suit.
The case has been adjourned to April 20 for hearing.
