Supreme Court Backs David Mark as ADC Chairman as INEC Restores Leadership List

Nigeria’s political space has taken another decisive turn after the Independent National Electoral Commission moved swiftly to restore the leadership of the African Democratic Congress following a Supreme Court ruling that overturned an earlier directive.

Independent National Electoral Commission updated its official records to reflect David Mark as National Chairman of the African Democratic Congress, with Rauf Aregbesola listed as National Secretary.

The update, which appeared on the commission’s portal late Thursday, effectively reverses a controversial decision taken just weeks earlier.

Also reinstated alongside the leadership were other key members of the party’s national structure, including Mani Ahmad as National Treasurer, Akibu Dalhatu as National Financial Secretary, and Oserheimen Osunbor as National Legal Adviser.

The development follows a prolonged legal tussle over who legitimately controls the party’s leadership. In April, INEC had removed the names of Mark and his allies from its database in compliance with a directive from the Court of Appeal, a move that triggered backlash from the faction loyal to the former Senate President and drew attention from opposition figures.

At the heart of the dispute is the recognition of David Mark’s leadership and the broader structure of the party’s national hierarchy. The disagreement has played out across multiple courts, reflecting deeper internal divisions within the ADC at a time when political realignments ahead of the next election cycle are already underway.

The turning point came with the Supreme Court’s intervention. In its ruling, the apex court nullified the earlier Court of Appeal directive, stating that the instruction to maintain the “status quo ante bellum” could not continue once the substantive issues had progressed. The court described the continued enforcement of that order as both unnecessary and legally unsustainable.

By allowing the appeal filed by Mark’s faction, the Supreme Court effectively restored their recognition, paving the way for INEC to reinstate the leadership structure on its official platform.

However, while the decision resolves the immediate administrative question that led to INEC’s earlier action, it does not bring the entire dispute to an end.

The court also directed that the suit filed by Nafiu Bala at the Federal High Court should proceed and be determined on its merits, meaning the underlying leadership challenge remains active.

This leaves the ADC in a transitional phase. On one hand, the Mark-led leadership now enjoys official recognition from the electoral body. On the other hand, the final outcome of the broader legal battle could still reshape the party’s internal structure depending on how the Federal High Court rules.

The implications of this development extend beyond internal party politics. With Nigeria’s political landscape already shifting in anticipation of future elections, control of party leadership structures is critical for alliance building, candidate selection, and strategic positioning.

For now, the restoration of David Mark’s leadership marks a significant win for his faction and reasserts their influence within the ADC. But with the substantive case still pending, the stability of that control remains subject to further judicial review.

As events continue to unfold, the ADC’s internal dynamics will be closely watched, not just by party members, but by the wider political community looking to gauge how emerging alignments could shape the road ahead.
